Automobile claims arise when Louisiana State University (LSU) is legally liable for bodily injury or property damage caused by the use of University owned, rented or leased automobiles.

All claims for liability or physical damage to state-owned, leased or rental vehicles are to be reported to the LSU Risk Management. If a loss involves property damage estimated at $5,000 or more, or involves bodily injury, the loss is to be reported immediately by telephone to LSU Risk Management at (225) 578-3283. A State of Louisiana Driver Safety Program Accident Form (DA 2041) and Workers’ Compensation Injury Report Form must be submitted within 48 hours of an auto accident even if there is no damage to the vehicle or employee! The deductible for auto collision and comprehensive claims is $1,000. All departments are responsible for the $1,000 deductible per accident, for collision and comprehensive coverage.

  • Rental Agreement
  • Travel Authorization

The University does not provide physical damage insurance to a personal vehicle; however, there may be up to $1,000 coverage provided toward the employee's vehicle property damage deductible, in instances when property damage results while using the employee's personal vehicle for university business.

If the State employee is not at fault in the collision and the negligent party’s insurance pays for the loss of the employee’s vehicle, then no reimbursement is allowed. It is not the insurance carrier’s intent for the employee to collect the deductible reimbursement when the other party’s insurer has paid the loss in full.

If someone is involved in an auto accident with a state vehicle and wants to file a claim with the insurance carrier, the following information is required:

  • Name, address, and phone number
  • A police report if filed (City, State, Sheriff, LSU PD)
  • Make, model, year of vehicle and VIN number
  • A copy of the vehicle registration
  • A copy of the insurance verification
  • Two estimates of damages (if car is drivable)
  • Pictures, if available

Reduction of Automobile Liability Limit When State Vehicle is Operated on Personal Business

When an employee using a State vehicle causes an accident and it is determined that he or she was on personal business and not acting in the course and scope of employment at the time of the accident, the State Office of Risk Management will only pay the statutory minimum limits of the state having jurisdiction. The minimum limits in the State of Louisiana are $15,000 bodily injury per person, $30,000 bodily injury for all persons per accident, and $25,000 property damage per accident.

The State of Louisiana has contracted for vehicle rentals based out of Louisiana through Enterprise Rent-A-Car’s State Motor Pool Rental Contract for business travel which applies to all State of Louisiana employees and/or authorized travelers traveling on official state business.

Collision Damage Waiver (CDW) insurance and $1 Million Liability Protection Coverage is included in the State Motor Pool Rental Contract price through Enterprise Rent-A-Car. Effective January 19, 2010, departments (employees) renting a vehicle for official state business from Enterprise State Motor Pool Rental Contract that are involved in an accident will not be subject to the $1,000 deductible. All accidents must be reported to our office immediately regardless the amount of damage. This applies to Enterprise State Motor Pool Rental Vehicles Only!

In the event of an automobile accident while utilizing a rental vehicle, the following is required:

Complete a DA 2041 LA State Driver Safety Program Accident Report Form within 48 hours and forward to LSU Risk Management along with a copy of:

  • Rental Agreement
  • Travel Authorization
  • Driver’s License
  • Police Report or Agency Name and Police Report Number
  • Pictures, if available

Please refer all correspondence and telephone calls from the rental car company or the other party to LSU Risk Management at 225-578-3283.

Any persons who are not official state employees must sign a State of Louisiana Hold Harmless/Indemnification Agreements prior to riding in or driving a state-owned or rental vehicle on behalf of the State.

Students shall not be authorized to drive state-owned or rented vehicle for use on official state business if not employed by the State.
